CitiMortgage, Inc. v. Platinum Home Mortgage Corp.

U.S. District Court for the Eastern District of Missouri · 2017

Jenkins Kayayan LLP delivered the first defeat of CitiMortgage’s thirty-six-to-zero record on dispositive motions in its securitized‑mortgage putback litigation against correspondent lenders.

Representing defendant Platinum Home Mortgage Corporation in CitiMortgage, Inc. v. Platinum Home Mortgage Corp., No. 4:15-cv-01242-MTS, in the United States District Court for the Eastern District of Missouri, Jonathan M. Jenkins and Lara Kayayan prevailed on summary judgment in 2017.

The decision marked the first time in CitiMortgage’s history that the plaintiff had lost a dispositive motion in a securitized mortgage putback case, breaking a sequence of dispositive wins that no defendant had previously interrupted in this category of litigation.

The result is one of several in a nationally recognized mortgage repurchase defense practice that Jenkins Kayayan LLP has built representing correspondent lenders and mortgage producers against repurchase demands brought by Fannie Mae, Freddie Mac, securitization trusts, and private investors.
